Terms and Conditions
1. Introduction
These Terms and Conditions outline the general basis on which ATWAM GROUP (“ATWAM,” “we,” “our”) provides services. The specific terms applicable to any engagement are defined in the accepted quotation, signed contract, or project agreement issued for that engagement.
2. Services
ATWAM provides construction, renovation, fit-out, MEP, specialist works, and related professional services in the UAE. The scope of services, deliverables, and timescales for each engagement are defined in individual project proposals, quotations, or contracts.
3. Quotations and Proposals
- Quotation validity is stated in each issued quotation document.
- Acceptance of a quotation in writing constitutes agreement to the quoted scope and price.
- Quoted prices are based on information provided at the time of quotation. Changes to scope, access conditions, or site circumstances may require price adjustment, which will be agreed in writing before additional works proceed.
4. Project Variations
- Any variation to the agreed scope must be submitted in writing and confirmed by ATWAM before work on the variation commences.
- ATWAM will provide a cost and programme impact assessment for each variation.
- Verbal instructions to vary the scope do not bind ATWAM until confirmed in writing.
5. Client Obligations
You agree to:
- Provide accurate and complete information about site conditions and project requirements
- Ensure reasonable site access as required by the agreed programme
- Make decisions in a timely manner to avoid programme delays
- Make payments in accordance with the agreed schedule
- Notify ATWAM promptly of any changes to requirements or site conditions that may affect the works
6. Payment Terms
- Payment milestones and terms are as specified in the project contract or accepted quotation.
- Invoices are payable within the timeframe stated on the invoice unless otherwise agreed in writing.
7. Quality and Completion
ATWAM carries out all works with reasonable skill and care, using materials of appropriate quality, in accordance with the agreed specifications. Warranty provisions, defects liability, and post-completion obligations are defined in the applicable project contract or accepted quotation.
8. Intellectual Property
Intellectual property terms relating to designs, drawings, and other materials prepared for a project are defined in the relevant project contract or accepted quotation.
9. Liability
Liability terms are governed by the signed project agreement and applicable UAE law.
10. Additional Terms
Provisions relating to force majeure, confidentiality, suspension of works, and dispute resolution are defined in the applicable project contract or accepted quotation. These general Terms and Conditions are provided as a reference framework only.
11. Governing Law
These terms are subject to the laws of the United Arab Emirates.
12. Changes to These Terms
ATWAM may update these Terms and Conditions. The version in force at the time a quotation is accepted governs that engagement.
